Either you use a lot of minutes on your cell phone or just an occasional wireless caller, you will save money with a prepaid wireless mobile services offered by LDPOST.
The different prepaid wireless plans that LD Post offers are designed for different types of usage.
Customers have the choice of 2 different plans:
If you have a phone that you need activated, then you will need to use the plan that corresponds to your phone's standard - CDMA or GSM
Both GSM and CDMA services clearly have advantages and disadvantages to them. In general CDMA phones receive better service coverage then GSM phones. So if service coverage is what you are after CDMA is technology for you. CDMA phones also have a higher data transfer rates and emit a smaller amount of radiation.
Advantages of GSM phones can be seen through their versatility. Virtually everywhere around the world currently uses GSM technology. While United States GSM phones broadcast at different frequencies then many other GSM networks around the world multi-band phones can be obtained so traveling with your phone is easy. GSM phones also use a Sim card, which make switching phones an easy and painless process.
Both services receive comparable prices for prepaid minutes starting at 5 cents per minute. Therefore if cost is not the determining factor, here is what should be. The deciding factor as to which phone is right for you should depend on local service coverage in your area and areas that you frequently travel to. If you are concerned about service coverage, remember that in general CDMA phones will receive better coverage then GSM, however both service provide adequate coverage to most parts of the United States.
If you already have a phone that you would like Long Distance Post to activate for prepaid wireless, you must go with the network that your phone currently operates on. It is not possible to change the network that a phone operates on.
These plans have very similar conditions, but you should still see each plan's web page for more details before making a purchase.
If you placed an order for a mobile phone or an activation kit that requires shipment, the order will be fulfilled and shipped by the next business day for all stocked items. You can choose between delivery methods - we ship UPS ground and USPS overnight.
If you placed an order for a Starter kit that does not need to be shipped, like Locus Platinum CDMA starter KIT, then the phone activations instructions will be e-mailed to you not later then the next business day.
If for any reason we can't fulfill your order by the next business day due to technical issues or because the requested phone number is being out of stock, we will contact you by phone or e-mail. We will cancel the order and issue a full refund at your request if we can't fulfill your activation request timely.
For the first time customers who purchase Mobile recharge cards, it might take anywhere from few minutes to 48 hours to receive the order, as our credit card fraud protection policy requires order verification. We will call you back to verify the order as soon as it is possible. When your order verified and approved, the dialing instructions will be e-mailed to you instantly along with the temporary password. All you consecutive orders for recharge cards will be e-mailed to you automatically and instantly.
Locus Mobile only works in the USA and Canada.

GSM is the only standard that uses SIM cards - small cards that are inserted under the battery. If your phone has one, then it is most likely a GSM phone, however Nextel phones also use the SIM cards, but are not compatible with GSM phones.

No, unfortunately we cannot. While Sprint phones do operate on a CDMA network, they need to be reprogrammed in order to work on Verizon's network. Long Distance Post does not reprogram or unlock phones.
No. The air-time from the recharge card is added just once - the whole balance of the recharge card will be added to the phone. All calls are made without dialing PIN.
Every time you are making call, the minutes balance should be announced.
Not immediately. There is 1 month period allowed for you to keep the phone number without having any minutes on the phone. After one month with zero balance you will lose your service and the phone number. To reactivate your service you will need to buy a new Activation Kit, but the phone number will be issued new.

Terms and Conditions
Funds deposited into your account expire after 6 months. If additional USA Paks are placed into your account before the current account balance expires, the existing balance will be carrier over to the new expiration date.
For all incoming Service, the length of the call will be measured during the time that you are connected to our system, which is approximately from the time your press 'Send' or other key to answer a call until approximately the time you press 'End,' or other key to terminate the call. For all outgoing Service, the length of the call will be measured from when you are released by the automated balance notification system until approximately the time your press 'End,' or other key to terminate the call. Airtime usage on each call to any USA destination is deducted in full minute increments, with partial minutes of use rounded up to the next full minute.
Airtime cannot be returned or exchanged once purchased.
You cannot place calls to 500, 700, 855, 900 or 976 numbers; or place operator-assisted calls such as third-party-billed and collect calls.
You will be billed at USA Pak airtime rates for calls to 800, 866, 888, 877 and other 'toll-free' numbers and International Pak recharges.
There may be a surcharge for incoming calls made from pay phones.
Directory Assistance is billed at $1.25 per call plus applicable per minute airtime USA Pak charges.
No charge for text message received. Send, forward, and reply to text messages for $0.10 per message. If an incoming call has been forwarded to another phone number, you will be charged $0.40 per call plus applicable USA Pak minutes for the entire time that our system handles the call. USA Pak charges apply for both calls when using the call waiting feature. You will be charged USA Pak rates for each leg of a conference call.
Get the most out of your wireless service by knowing the parameters of your Agreement with us. Your relationship with us is governed by the Terms and Conditions contained in the User Guide that you received when your phone. IF YOUR REPLENISH THE BALANCE ON YOUR ACCOUNT OR USE THE SERVICE OR THE PHONE, YOU CONSENT TO THE TERMS AND CONDITIONS.
Yes. You can take your existing phone number from your current provider and port it to one of our services:
It takes anywhere from 2 to 30 days to port your number. Do not discontinue your service with your current provider untill we finish porting your phone number. Otherwise, you will lose the number, and we will not be able to do anything.
Yes, You can forward your mobile calls to another number in USA.
Here is how you can activate Call Forwarding:
- Scroll through the menu and select Settings
- Scroll down and select Call Settings or Call Manager
- Scroll down and select Forward Calls
- Select Voice Calls
- Select Always Forward
- Select Activate
- Enter the 10-digit number to forward all calls to and select OK
- Call Forwarding will remain active until you deactivate the feature.
To Deactivate Call Forwarding do the following:
- Scroll through the menu and select Settings
- Scroll down and select Call Settings or Call Manager
- Scroll down and select Forward Calls
- Select Voice Calls

SIM stands for Subscriber Identity Module. A SIM card is a small "smart card" for GSM/GPRS mobile phones that contains your personal account profile as well as saves important information (i.e. network information, account services, your mobile phone number, stored telephone numbers, SMS messages and more). The SIM card must be inserted in the handset in order for it to operate.
Before you order an Activation Kit, you will need to know the standard that your phone uses - CDMA or GSM - so you can order the correct product.

The only practical way to find out if the phone is unlocked or at least will be working with O2 Oxygen Wireless is to borrow a SIM card from another Cingular GSM phone. You can borrow a SIM card from somebody you know. There is no harm to be made to a SIM card by inserting it in the phone. If your phone works with the borrowed SIM card, then you are all set. If you see a Cingular logo on the GSM phone, then it is most probably will work with O2 Oxygen Wireless.
a. Remove battery from your phone b. Carefully push out SIM from the Plastic cardholder c. Place SIM into the phone's SIM cardholder with the gold square facing down and positioned so the metallic face of the SIM is lined up with and touching the metal contacts on the phone. d. Close the phone's SIM cardholder until it clicks e. Replace the battery and battery cover f. Turn on your Phone g. If installation is successful, "O2 Wireless," "Locus," or "My Network" should be in the phone's display h. If "Insert SIM Card," "Check SIM," "SOS Only," or "Unregistered SIM" appears in the phone's display, remove the SIM and re-insert as instructed above.
H2O Wireless GSM Minutes recharge cards will provide you with the following number of minutes:
- $10 - 70 minutes
- $20 - 140 minutes
The expiration period depends on the value of the recharge card:
- $10 - 90 days
- $20 - 90 days
All recharge cards have a Rollover effect - when you add more minutes to your account, then all of your minutes - old and new - receive the extra time.
Yes.
When you add additional minutes before your old minutes have expired, all of your minutes - old and new - receive another period of time, according to the recharge card that you are using.
Please note that if your minutes have already expired, the new recharge card will not restore the lost minutes.
Yes. It is free to retrieve voicemail from a land line phone.
1. Dial your wireless phone number. 2. Press 1 if calling from your wireless phone. Press * if calling from any other phone. 3. Enter your pass code. 4. The system will automatically play the new voice messages.
No. There are no any daily or monthly fees with H2O GSM Minutes service
Except for promotional free minutes given with activation if any, all separately purchased minutes will roll over and will be added to the full balance off the phone for the duration of the expiration period of the purchased card.
Example:
You have 20 minutes left from your $10 card. You bought a $10 card and added 70 minutes to your phone. Your total minutes now is 90. All these minutes are good for 90 days now.
No. There is no additional activation fee. The price of the phone includes the cost of activation kit and free minutes.
Simply dial and you'll receive a message, in your phone's display, indicating the remaining balance. If you need assistance, please dial from your handset (this is a FREE call).
You will need to ensure the new phone is a Cingular and FCC approved GSM 850/1900, dual, tri, or quad-band handset that can be used for activations on O2 Oxygen Wireless GSM. Take the SIM card from your current phone and insert it in your new phone. You can now use your new phone as you normally would.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. They govern the relationship between you and H2O GSM (Locus Telecommunications, Inc.) and explain our respective legal rights concerning all aspects of our relationship, including without limitation:
- Rates and charges
- Availability of the service and features
- Replenishment and expiration of balances
- Privacy and confidentiality
- Your rights related to Customer Proprietary Network Information
- Modifications to the agreement
- Limitations of liability and warranty
- Resolution of past or future disputes by mandatory binding arbitration instead of court trials and class actions.
IF YOU USE THE SERVICE OR THE WIRELESS DEVICE, YOU CONSENT TO THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT USE THE SERVICE OR PHONE AND NOTIFY US IMMEDIATELY TO CANCEL SERVICE. This is an agreement ("Agreement") for wireless radio telecommunications services and related services and/or features ("Service") between you and the entity licensed by the Federal Communications Commission to provide Service in the area associated with your assigned telephone, data and/or messaging number(s) ("Number") that is doing business as H2O Wireless GSM, ("us" or "we"). The term "Device" means wireless receiving and transmitting equipment that we have authorized to be programmed with the Number.
I. SERVICE a. Availability/Interruption. Service is normally available to your Device when it is within the operating range of our system, and may be available outside of that area in other participating carrier service areas. Service is subject to transmission limitation or interruption caused by weather, terrain, obstructions such as trees or buildings, and other conditions. Service may be limited in some areas where coverage is not available or may be temporarily limited or interrupted due to system capacity limitations and system repairs or modifications or to combat potential fraud. GSM wireless features require a compatible GSM 850/900/1900 dual, tri, or quad band phone, are only available in the GSM features area, and may require local telephone company support and message sender access to computer and modem. Not all features or Service offerings are available.b. Use of Service/Device/Number. Reproduction, retransmission, dissemination or resale of Service is prohibited without prior written contractual arrangements from Locus Telecommunications, Inc. and any required regulatory approvals. You are responsible for ensuring that your Device is compatible with our Service and meets federal standards. You are responsible for the purchase and maintenance of any additional hardware, software and/or Internet access from your PC required to use the Service. You consent to receiving advertising, alerts and other broadcast messages from Locus Telecommunications, Inc. or our authorized agents. You have no ownership rights to the Number, any IP address, any e-mail address or any other identifier provisioned by us, our agents or the manufacturer of your Device to be used with the Service, and you agree we may change any such Number, IP address, e-mail address or any other identifier at any time with or without prior notice to you. Any Device purchased through our program has been manufactured to operate exclusively with Service provided by us. The Device cannot be activated with any other wireless carrier. By using Service, you agree to abide by the terms and conditions of any applicable software license. c. Unauthorized Usage. You agree not to use the Device or Service for any unlawful, unauthorized or abusive purpose or in any way that damages our property or others' property, or interferes with, harms or disrupts our system or other operators' systems or other users. You will comply with all laws while using the Service and you will not transmit any communication or data that would violate any laws, court order, or regulation, or would likely be offensive to the recipient. You are responsible for all content you transmit using the Service. You may not install any amplifiers, enhancers, repeaters or other devices that modify, disrupt or interfere in any way with the radio frequency licensed to us to provide Service. If your Device, user name or password is stolen or Service is fraudulently used, you must immediately notify us and provide us with such documentation and information as we may request (including affidavits and police reports). Until you notify us, you will remain responsible for all charges. We have the right to interrupt or restrict Service to your Number, without notice to you, if we suspect fraudulent, illegal, or abusive activity. You agree to cooperate with us in any fraud investigation and to use any fraud prevention measures we prescribe. Failure to provide reasonable cooperation may result in your liability for all fraudulent usage. d. Release of Information. You consent to our release of information about you when we believe release is appropriate to comply with the law (e.g. a lawful subpoena, E911 information); to enforce or apply our customer agreements; to initiate, render, bill and collect for Services; to protect our rights or property; to protect users of those Services and other carriers from fraudulent, abusive, or unlawful use of, or subscription to, such Services; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay. You are deemed to have reviewed and consented to our Privacy Policy posted on our website at www.O2WirelessService.com. e. Your Rights to End This Agreement. You may terminate your Service at any time by notifying us of your intention to terminate Service. There is no penalty or termination fee; however, it may take up to 30 days to process the termination request and the balance remaining in your account is forfeited upon termination of Service. Your Service will resume and the termination request will be cancelled if you use your Service prior to our processing your termination notification.II.
II. CHARGES/PAYMENTS/DEFAULT a. Generally. You are responsible for paying all charges, including but not limited to: airtime, access, features, voice mail access, voice mail delivery, data usage, text messages, downloadable content, alerts, roaming, long distance, directory and operator assistance charges, the price of Devices and accessories, charges for other goods and services and shipping/handling fees. You will be billed at domestic airtime or roaming rates (please refer to rate card) for 800, 866, 877, 888, and other "toll free" calls. Applicable international charges will always be billed for direct dial calls placed from your wireless phone. A long distance provider chosen by Locus Telecommunications, Inc. will provide your long distance. For all calls, the length of the call will be measured during the time that you are connected to our system, which is approximately from the time you press "Send" or other key to begin a call until approximately the time you press "End," or other key to terminate the call. Airtime usage on each call is deducted in full minute increments, with partial minutes of use rounded up to the next full minute. For calls placed in the United States, you will not be charged for busy or unconnected calls if you press "End" or "No" within 30 seconds. Unanswered calls lasting 30 seconds or more will be charged standard airtime and rounded up to the nearest minute. Call waiting, 3-way calling, call forwarding, voicemail will incur applicable airtime or roaming and wireless long distance charges. Please note you may be charged a higher rate for calls made off-network. You will be charged for any check or electronic bank draft returned for non-payment. Please refer to your rate card for details. b. Account Balance. All charges incurred will be deducted automatically from your account. Any amounts loaded into your account are not transferable or refundable. You should take reasonable efforts to safeguard your Phone and replenishment airtime cards. No refunds or other compensations will be given for returned, expired, lost, damaged, or stolen cards. Amounts deposited to your account expire between 30 to 90 days depending on card denomination. However, if additional amounts are placed into your account before the current account balance expires, the existing balance will be carried over to the new expiration date. If new amounts are not added to your account prior to the expiration date any remaining amounts will be forfeited. Your account will be canceled if there is no usage (billable or non-billable) or if the balance remains as $0 for 30 consecutive days or more and you may be required to pay a fee to resume service. Credit card replenishment is available; limitations apply. In some instances you may be able to complete a call when the billing functionality is interrupted. When this occurs you will not receive correct balance information. All calls, however, will be deducted from your account and the balance updated when the billing functionality is operable. You are responsible for all data usage sent through our network and associated with the Device, regardless of whether the Device actually receives the information. c. Use of Service/Rates. Your Service rates and other charges and conditions for each Number or Phone are described in the replenishment card packaging, at our website at www.O2WirelessService.com, and in the "Sales Information" (the user guide and other printed materials provided by us either in the Starter Kit you received when submitting your Device for use with the Service or in the packaging of the Device you purchased to be used with the Service) you received, each of which is a part of this Agreement. You can place domestic and international calls from the U.S. to certain designated international locations. The prepaid per minute rates are based on the card value purchased. International rates vary and are subject to change. Call Customer Care (at the number listed on our website or in your replenishment card packaging) or visit www.O2WirelessService.com for international rates and available countries. You cannot use the Service to place calls to 500, 700, 855, 900 or 976 numbers; or to place operator-assisted calls such as third-party-billed, and collect calls. Rates for calls to directory assistance are $3.00 per call plus airtime or roaming charges. You will be billed at domestic rates for 800, 888, 877, and 866 number calls. You are responsible for all taxes and surcharges associated with your use of the Service. Other than calls to 911, you can only make and receive calls when your account has a positive balance. Special dialing patterns may be required when making roaming calls. Some locations require a credit card to complete a call; these rates will be higher. When in these areas, you will not be able to receive calls. Prepaid wireless service is not available for purchase or use in all areas. When using Call Waiting or Three-Way Calling, you will incur two simultaneous airtime charges and if you disconnect from a conference call while the other two parties remain connected, you will continue to incur airtime charges for all calls. d. Default/Termination. If you breach any representation to us or fail to perform any of the promises you made in the Agreement, you will be in default and we may, without notice to you, suspend Service and/or terminate this Agreement, in addition to all other remedies available to us. e. Account Information. Any person able to provide your Number and personal identification number is authorized by you to make changes to your account. You consent to disclosure of any information about you to any person as permitted by law if any Device programmed with your Number calls an emergency service number such as 911 or, if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay f. CPNI Consent. Under federal law, you have a right, and we have a duty, to protect the confidentiality of information about the amount, type, and destination of your wireless service usage (CPNI). You consent to us sharing your CPNI with Locus Telecommunications, Inc., its affiliates and its contractors, to develop or bring to your attention any products and services. This consent survives the termination of your Service and is valid until you remove it. To remove this consent at any time, notify us in writing at Locus Telecommunications, Inc. Attn: CPNI, P.O. Box 376 Fort Lee, NJ 07024, providing your name, home address, home telephone including area code, and personal identification number. Removing consent will not affect your current Service.
III. CHANGES TO THIS AGREEMENT We may amend the terms of this Agreement upon advance notice to you in the manner described below or by posting notices of changes on our website or by printing notice of such changes in the replenishment card packaging.
IV. LIMITATIONS The parties intend that the limitations on liability, warranty and damage awards provided for in this Agreement will apply to the fullest extent allowed by law. Some jurisdictions do not allow the exclusion of certain warranties or the waiver, limitation or exclusion of liability for punitive, incidental or consequential damages, or for intentional or willful conduct in some circumstances. To the extent that applicable law does not permit any of these limitations, they will not apply to you.
a. Limitation of Liability. WE ARE NOT LIABLE FOR ACTS OR OMISSIONS OF ANOTHER SERVICE PROVIDER OR ANY THIRD PARTY PROVIDERS OF SERVICES RELATED TO USE OF THE DEVICE OR SERVICE, FOR INFORMATION PROVIDED THROUGH YOUR DEVICE, LACK OF PRIVACY OR SECURITY EXPERIENCED WHEN USING THE DEVICE, EQUIPMENT FAILURE OR MODIFICATION, OR OTHER CAUSES BEYOND OUR REASONABLE CONTROL, INCLUDING WITHOUT LIMITATION ANY REPRESENTATIONS THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM UNAUTHORIZED ACCESS (INCLUDING THIRD PARTY HACKERS OR DENIAL OF SERVICE ATTACKS). WE ARE NOT LIABLE FOR SERVICE OUTAGES, NOR FOR SERVICE LIMITATIONS OR INTERRUPTIONS, AS DESCRIBED IN PARAGRAPH 1.C ABOVE. OUR LIABILITY AND THE LIABILITY OF ANY UNDERLYING CARRIER FOR ANY FAILURE OR MISTAKE SHALL IN NO EVENT EXCEED OUR SERVICE CHARGES DURING THE AFFECTED PERIOD. Locus Telecommunications, Inc., AND ANY UNDERLYING CARRIER ARE NOT LIABLE FOR ANY INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES SUCH AS LOST PROFITS. YOU AND WE BOTH WAIVE TO THE FULLEST EXTENT ALLOWED BY LAW, ANY CLAIMS TO RECOVER INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES. WE AND ANY UNDERLYING CARRIER ARE NOT LIABLE FOR (i) ECONOMIC LOSS OR INJURIES TO PERSONS OR PROPERTY ARISING FROM USE OF THE SERVICE, THE DEVICE OR ANY EQUIPMENT USED IN CONNECTION WITH THE DEVICE UNLESS CAUSED BY OUR SOLE AND GROSS NEGLIGENCE, OR (ii) THE INSTALLATION OR REPAIR OF THE DEVICE BY ANY PARTIES WHO ARE NOT OUR EMPLOYEES. THIS PARAGRAPH SHALL SURVIVE TERMINATION OF THIS AGREEMENT. b. Indemnification. YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD US, OUR AFFILIATES AND AGENTS AND ANY OTHER SERVICE PROVIDER, HARMLESS FROM CLAIMS OR DAMAGES RELATING TO THIS AGREEMENT OR YOUR PROMISES OR STATEMENTS MADE IN IT AND USE OF THE DEVICE OR SERVICE UNLESS DUE TO OUR SOLE AND GROSS NEGLIGENCE. YOU ALSO AGREE TO PAY OUR REASONABLE ATTORNEYS' AND EXPERT WITNESS FEES AND COSTS INCURRED IN ENFORCING THIS AGREEMENT THROUGH APPEAL EXCEPT AS PROVIDED IN PARAGRAPH 5, BELOW. USE OF YOUR DEVICE WHILE OPERATING A MOTOR VEHICLE OR IN ANOTHER DISTRACTED OR NEGLIGENT MANNER MAY BE PROHIBITED, OR RESTRICTED BY LAW IN SOME AREAS. IT IS YOUR RESPONSIBILITY TO CONFORM TO ALL SUCH LAWS OR REGULATIONS AND YOU SHALL INDEMNIFY US FROM CLAIMS ARISING FROM ANY SUCH UNLAWFUL OR NEGLIGENT USE. THIS PARAGRAPH SHALL SURVIVE TERMINATION OF THIS AGREEMENT. c. No Warranties. WE DO NOT AUTHORIZE ANYONE TO MAKE ANY WARRANTY ON OUR BEHALF AND YOU SHOULD NOT RELY ON ANY SUCH STATEMENT. WE ARE NOT THE MANUFACTURER OF THE DEVICE AND ANY STATEMENT REGARDING IT SHOULD NOT BE INTERPRETED AS A WARRANTY. THIS PARAGRAPH SHALL SURVIVE TERMINATION OF THIS AGREEMENT.
V. RESOLUTION OF DISPUTES PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS RIGHTS THAT YOU MAY OTHERWISE HAVE. IT PROVIDES FOR RESOLUTION OF MOST DISPUTES THROUGH ARBITRATION INSTEAD OF COURT TRIALS AND CLASS ACTIONS. ARBITRATION IS FINAL AND BINDING AND SUBJECT TO ONLY VERY LIMITED REVIEW BY A COURT. THIS ARBITRATION CLAUSE SHALL SURVIVE TERMINATION OF THIS AGREEMENT.
a. Binding Arbitration. It is intended that this provision be interpreted broadly to encompass all disputes or claims arising out of our relationship. Any dispute or claim, including those against any of our subsidiary, parent or affiliate companies, arising out of or relating to this Agreement, our Privacy Policy or the Service or any equipment used in connection with the Service (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration except that (1) you may take claims to small claims court if they qualify for hearing by such a court, or (2) you or we may choose to pursue claims in court if the claims relate solely to the collection of any debts you owe to us. b. Arbitration Procedures. You must first present any claim or dispute to us by contacting Customer Care to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute has not been resolved within 90 days. The arbitration of any dispute or claim shall be conducted in accordance with the American Arbitration Association ("AAA") under the Wireless Industry Arbitration Rules ("WIA Rules"), as modified by this Agreement. The WIA Rules and information about arbitration and fees are available upon request from the AAA online at www.adr.org. You and we agree that this Agreement evidences a transaction in interstate commerce and this arbitration provision will be interpreted and enforced in accordance with the Federal Arbitration Act and federal arbitration law. Unless you and we agree otherwise, any arbitration will take place in the county seat for the county in which your billing address is located. At either party's election, the arbitration shall be held telephonically. An arbitrator may award any relief or damages (including injunctive or declaratory relief) that a court could award, except an arbitrator may not award relief in excess of or contrary to what this Agreement provides and may not order relief on a consolidated, class wide or representative basis. In any arbitration applying the WIA Rules applicable to large/complex cases, the Arbitrators must also apply the Federal Rules of Evidence, and the losing party may have the award reviewed in accordance with the review procedures set forth in the WIA Rules. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration clause is determined by a court to be inapplicable or invalid, then the remainder shall still be given full force and effect. c. Costs of Arbitration. For claims of less than $1,000, you will be obligated to pay $25 and we will pay all other administrative costs and fees. For claims over $1,000 but under $75,000, you will be obligated to pay your share of the arbitration fees, but no more than the equivalent court filing fee for a court action filed in the jurisdiction where your billing address is located. For arbitrations in excess of $75,000, all administrative fees and expenses of arbitration will be divided equally between you and us. In all arbitrations, each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration.
d. Waiver of Class Actions. By this Agreement, both you and we are waiving certain rights to litigate disputes in court. You and we both agree that any arbitration will be conducted on an individual basis and not on a consolidated, class wide or representative basis. If for any reason this arbitration clause is deemed inapplicable or invalid, or to the extent this arbitration clause allows for litigation of disputes in court, you and we both waive, to the fullest extent allowed by law, any right to pursue any claims on a class or consolidated basis or in a representative capacity. e. Limitations Period. Any arbitration or legal action with respect to any and all claims or causes of action related to or arising out of this Agreement must be brought within two years after the cause of action arises, or within the applicable statutory period of time, whichever is shorter. This limitations period does not apply to any given cause of action when the statutory limitations period for that cause of action cannot be waived, restricted or otherwise limited by you.
VI. MISCELLANEOUS a. Privacy. We are not liable for any lack of privacy, which may be experienced with regard to the Service. You authorize our monitoring and recording of calls to us concerning your account or the Service and consent to our use of automatic dialing equipment to contact you. We have the right to intercept and disclose any transmission over our facilities in order to protect our rights or property. b. Assignment. We may assign all or part of this Agreement without such assignment being considered a change to the Agreement, and without notice to you. We are then released from all liability. You may not assign this Agreement without our prior written consent. c. Notices. We may send you notice by mail or electronic means, in our sole discretion. Notices to you shall be effective 1) 3 days following the date deposited in the U.S. Mail or delivered to a nationally recognized courier or delivery service, postage prepaid and addressed to your address as kept in our files and/or 2) immediately upon our transmission using an electronic means such as e-mail or text messaging service. You are responsible for notifying us of any changes in your mailing or e-mail address. Written notice to us shall be effective when directed to our Customer Care Department (at the mailing address listed on our website) and received by us. Oral and electronic notices shall be deemed effective on the date reflected in our records. Your notice must contain specific information adequate to identify you and your Service. d. Entire Agreement. These Terms and Conditions, together with the Sales Information, represent the entire agreement between you and us, which may only be amended as described in this Agreement. This Agreement supersedes any inconsistent or additional representations made to you by any of our representatives, agents or dealers. If any part of this Agreement is found invalid, the balance of the Agreement remains enforceable. If, at any time, we do not enforce any right or remedy available under this Agreement, that failure is not a waiver of our right to enforce the right or remedy at a later time. Copied, microfiche, scanned or other duplicate or electronic images of this Agreement are admissible for all purposes. e. Governing Laws. This Agreement is subject to applicable federal laws, federal or state tariffs, if any, and the laws of the state associated with the Number. Where a state agency or the FCC regulates the terms and conditions of our Service, the regulations are available for your inspection; if there is any inconsistency between this Agreement and those regulations, this Agreement shall be deemed amended as necessary to conform to such regulations. f. Capacity. You represent that you are legally competent to enter into this Agreement, and that you are not aware of any disability that would prevent you from entering into this Agreement.

General Questions
SIM stands for Subscriber Identity Module. A SIM card is a small "smart card" for GSM/GPRS mobile phones that contains your personal account profile as well as saves important information (i.e. network information, account services, your mobile phone number, stored telephone numbers, SMS messages and more). The SIM card must be inserted in the handset in order for it to operate.
Before you order an Activation Kit, you will need to know the standard that your phone uses - CDMA or GSM - so you can order the correct product.
The easiest way to find that is to see what carrier was it previously used on. Here are some of the major carriers:

No, you cannot choose your own phone number. As our automated system finds the area code you requested and searches from a pool of numbers which are currently available in the US. Unfortunately, there is no way for us to choose a number.
The process itself only takes a few minutes. Normally, within 1-2 hours, your H2O Wireless phone will be ready for your use.
No, it is absolutely free to transfer your old phone number. And plus, H2O Wireless is a no-contract service so there are no early termination fees.
We'll move your number to H2O Wireless as fast as possible. Right now, moving a wireless phone number to H2O Wireless can take up to 3 days - moving a land-line number can take up to 5 days.
The actual time to move a number depends on a few things - your old provider, the demand for portability, and the accuracy of information. Once your number is ready to use on our network, we will call you or leave a voicemail letting you know that you are good to go.
If you don't wish to wait for your old number to be switched over, you can always get a new H2O Wireless number almost in an instant.

Note: If the phone is currently active, unused airtime minutes can be transferred to the new number. A new SIM card may be needed if you change your mobile number to one outside your service area.
As long as you still have an unused, new H2O Wireless SIM card, you can reactivate it. However, your previous phone number will no longer be available.
Resolving problems
Contact Customer Care at 1-800-643-4926 and provide your mobile number and the PIN and serial number on the airtime card you are attempting to transfer to your account.
Note: Only H2O Wireless UNLIMITED airtime cards will work on your phone. If you purchased another type of airtime card, return it to where you purchased the card. If your Dealer/Retailer added the card to your phone, please return to the dealer or contact them and explain the situation

If your handset is newly activated, ensure that enough time has been allowed for the system to activate the phone. Check to see that the airtime minutes were loaded on the handset. If the problem persists, dial 611 SEND from your handset (this is a FREE call) or contact Customer Care from any phone at 1-800-643-4926. Please have your mobile number and IMEI ready.
Using Your Phone & Device
Basics
To make a phone call, enter the 10-digit phone number of the person you are trying to reach. You are required to enter the 10-digit phone number even if you have the same area code or are in the same vicinity of the person/place you are calling. (H2O Wireless does not charge extra for the domestic long distance.
Instructions may be different per phone, so if these steps do not work for you, please refer to your phone user manual.

- Select Add New Entry
- Press 'OK'
- Input contact's name and press 'OK'

- Repeat steps 5 - 8 to enter additional numbers for the same contact name
The number of contacts on a phone can vary by phone. However, it can hold 100 to 1,000 contacts generally. Please refer to your Phone user manual for details.
Please save the contacts to your H2O Wireless SIM card, not to your phone. This way, all you have to do when you get a new phone is to remove your H2O Wireless SIM card from your old phone to your new phone.

- To disconnect from the third party in a three-way call, press SEND once
- To disconnect from the original party in the three-way call, the original party must hang up. Airtime charges apply when using these features from your wireless phone.
Caller ID shows you the phone number of most incoming calls. If you don't want to answer your wireless phone and you have Voicemail, you can let the incoming call roll to your Voicemail box. Caller ID works whenever your phone is on. It even works when Call Waiting alerts you of an incoming call. Per Call Blocking allows you to selectively block the presentation of your wireless phone number.
- Enter *67 Phone Number you are calling and press SEND.
- Your number will show up as "anonymous" on the receiver's Caller ID.
Voicemail
- Dial your wireless phone number from your wireless phone or any other touch-tone phone.
- Follow the prompts and select 1 for English or 2 for Spanish.
- The system will ask you to enter your personal pass code. (think of an easy to remember pass code and enter it when prompted)
- The system will prompt you to record your own personal greeting or to select a standard greeting.
- After hearing, "the person who you are calling has a voicemail that has not been set up yet, goodbye" interrupt this greeting by holding down the *key
* In order to avoid being charged as a call, please call your H2O Wireless number from another phone while your H2O Wireless phone is turned off.
Contact Customer at 1-800-643-4926 and provide your mobile number and IMEI, which will be required for the voicemail to be reset. Once reset, all previously stored messages will be deleted.

This depends on how you set up your voicemail initially. If you selected 2 for Spanish then your voicemail will in Spanish. If you would like to change your language selection, you can do so by resetting your voicemail settings. Please call your voicemail and follow the prompts to reset your settings.
To send an incoming call to voicemail, press the 'end call' key (normally marked in red) on your phone. Some phones will display an option to send to voicemail as well. If this appears, highlight that option and press 'OK.'
Messaging
Text Messaging allows you to send or receive short alphanumeric messages (up to 150 characters in length) using your wireless phone. This feature also allows you to receive short messages originating at e-mail or web-based sources via your unique e-mail address of your 10-digit wireless number, plus: @txt.att.net

Changing text entry settings varies by phone. If these steps don't work for you, please refer to your Phone user manual.
All you have to do is change your text entry setting. Each phone type will use slightly different words to describe text entry settings. Most phones use 'ABC' mode' or 'Alpha' to mean one letter at a time, and "Word" to mean predictive text entry.
1. While you are entering text into a message, click on the 'Menu' key. 2. Scroll to and select the new text entry type. 3. Click 'OK.'
To send a text message to another H2O Wireless customer from email, place your friend's 10-digit H2O Wireless phone number followed by @txt.att.net in the "To" or address field.
For Example: If your wireless number is (555) 123-4567, your e-mail address is 5551234567@txt.att.net.
To send text messages from your email to friends who have service with other carriers, you would typically enter the email address as the 10 digit phone number of the person you want to send a message to, followed by the carrier's address.
If they reply, their message will go straight to your email inbox.

Yes, you can usually block up to 10 telephone numbers or email addresses from sending text messages to you.
Once a text message has been deleted, it cannot be retrieved from the system or the phone itself.
* MONTH Plan: International Text messages are unlimited to send and receive.
There are a couple of things that can cause your phone to stop sending or receiving messages. Many of them can be fixed by performing one or more of the followings:
- Use the area code: You must use the area code and phone number when sending a message.
- Keep your flip phone open: Phones that flip open and close must remain open while the text message is being sent. If you close the phone while it's still sending, your messages will not be sent.
- Clean out your Sent and Inbox: The messages that you receive and send are stored on your phone and can take up space! Keeping them can interfere with your ability to send or receive additional messages. Check your phone user guide for instructions on how to delete messages.

Additional services such as direct dialing to 411 directory assistance and international calls, incidentals and premium messaging services are not included in the H2O MONTH plan.
International Text messages are unlimited to send and receive.
If you have H2O Wireless MONTH plan, a direct dialing to 411 is currently unavailable.
However, you can get directory assistance at no additional charge (only pay your standard rate per minute, completely free if you have H2O Wireless MONTH plan) by dialing 1-800-goog411 or 1-800-free411.
Yes, you can send picture, audio or video now. 50MB of data and UNLIMITED Picture Messages are included with the H2O GSM Unlimited service.
No, H2O Wireless does not charge any sales taxes on any of its phones and/or plans.
No, it is absolutely free as long as you are trying to change your number within the same region of your current area code. If you are trying to change your area code to the one outside your current region, you will need an unused, new H2O Wireless SIM card.
Example 1) You currently have a NY area code and you would like a CA area code, you will need an unused, new H2O Wireless SIM card.
Example 2) You currently have a NJ area code (201) and you would like a NY area code (646), you do not need anything. The change can be made.

PRL stands for Preferred Roaming List. In order for you to update your phone to feature the new PRLs and know when you are on or off-network, all you need to do is dial *22891 + send from your activated phone. IF YOU USE THE SERVICE OR THE WIRELESS DEVICE, YOU CONSENT TO THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT USE THE SERVICE OR PHONE AND NOTIFY US IMMEDIATELY TO CANCEL SERVICE.
I. SERVICE a. Availability/Interruption. Service is normally available to your Device when it is within the operating range of our system, and may be available outside of that area in other participating carrier service areas. Service is subject to transmission limitation or interruption caused by weather, terrain, obstructions such as trees or buildings, and other conditions. Service may be limited in some areas where coverage is not available or may be temporarily limited or interrupted due to system capacity limitations and system repairs or modifications or to combat potential fraud. Digital PCS features require a compatible digital multi-network phone, are only available in the Digital PCS features area, and may require local telephone company support and message sender access to computer and modem. Not all features or Service offerings are available.
b. Use of Service/Device/Number. Reproduction, retransmission, dissemination or resale of Service is prohibited without prior written contractual arrangements with us and any required regulatory approvals. You are responsible for the purchase and maintenance of any additional hardware, software and/or Internet access from your PC required to use the Service. You consent to receiving advertising, alerts and other broadcast messages from us or our authorized agents. You have no ownership rights to the Number, any IP address, any e-mail address or any other identifier provisioned by us, our agents or the manufacturer of your Device to be used with the Service, and you agree we may change any such Number, IP address, e-mail address or any other identifier at any time with or without prior notice to you. By using Service, you agree to abide by the terms and conditions of any applicable software license.
c. Use of Premium SMS and Mobile Content. Locus Telecommunications, H2O Wireless and its underlying carrier, may provide you with access to a mobile content delivery service (each, a "Service"), together with a third-party content provider. This access will allow you to download to your compatible mobile phone various third-party mobile entertainment content, such as ringtones, wallpapers, games, graphics, data, news, etc. (collectively, the "Content") via the Internet, SMS, MMS, WAP, BREW and other means of mobile content delivery through the use of Premium SMS messaging or other mobile technologies. A surcharge of 50¢ will be assessed for Premium SMS messaging. This surcharge is in addition to and independent from any charges assessed by the third-party content provider. This surcharge, plus all other charges assessed by the mobile content provider, will be incurred when you consent to download the third party content provider's Content. By using these Content services you warrant and represent that (i) you have read and understood this Agreement and agree to be bound by its terms and conditions; (ii) you are at least 21 years of age; (iii) you are the owner of the Device whose phone number you are using, or if you do not own the Device you have explicit permission from the owner of the Device to use the Device and to enter the phone number for such Device; and (iv) you are a resident of the U.S. Please note, given the aforementioned herein, that the downloading of mobile Content and use of Premium SMS messaging is up to the discretion of the owner of the phone and whomever the owner gives permission to utilize these services. You agree to hold Locus Telecommunications, H2O Wireless and its underlying carrier harmless for any and all Content that is downloaded to your phone. If you do not agree (or cannot comply) with the terms and conditions of this Agreement, Locus Telecommunications / H2O Wireless Privacy Policy and any applicable Rules, you are not authorized to access or use any services or products, register for or use any Service provided by Locus Telecommunications, H2O Wireless and its underlying carrier, and your sole remedy is to immediately stop accessing and using any service or product provided by Locus Telecommunications, H2O Wireless, and its underlying carrier.
d. Unauthorized Usage. You agree not to use the Device or Service for any unlawful, unauthorized or abusive purpose or in any way that damages our property or others' property, or interferes with, harms or disrupts our system or other operators' systems or other users. You will comply with all laws while using the Service and you will not transmit any communication or data that would violate any laws, court order, or regulation, or would likely be offensive to the recipient. You are responsible for all content you transmit using the Service. You may not install any amplifiers, enhancers, repeaters or other devices that modify, disrupt or interfere in any way with the radio frequency licensed to us to provide Service. If your Device, user name or password is stolen or Service is fraudulently used, you must immediately notify us and provide us with such documentation and information as we may request (including affidavits and police reports). Until you notify us, you will remain responsible for all charges. We have the right to interrupt or restrict Service to your Number, without notice to you, if we suspect fraudulent, illegal, or abusive activity. You agree to cooperate with us in any fraud investigation and to use any fraud prevention measures we prescribe. Failure to provide reasonable cooperation may result in your liability for all fraudulent usage.
e. Release of Information. You consent to our release of information about you when we believe release is appropriate to comply with the law (e.g. a lawful subpoena, E911 information); to enforce or apply our customer agreements; to initiate, render, bill and collect for Services; to protect our rights or property; to protect users of those Services and other carriers from fraudulent, abusive, or unlawful use of, or subscription to, such Services; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay. You are deemed to have reviewed and consented to our Privacy Policy posted on our website at www.LocusPlatinum.com.
f. Your Rights to End This Agreement. You may terminate your Service at any time by notifying us of your intention to terminate Service. There is no penalty or termination fee; however, it may take up to 30 days to process the termination request and the balance remaining in your account is forfeited upon termination of Service. Your Service will resume and the termination request will be cancelled if you use your Service prior to our processing your termination notification.
g. Number Portability. You may be able to take your current wireless phone number to another service provider. This is called "porting" and will also terminate our service to you for that number. If you request your new service provider to port a number from us, and we receive your request from that new service provider, we'll treat the request as notice from you to terminate our service for that number upon successful completion of porting. After the porting is completed, you won't be able to use our service for that number even if you have unused airtime on that account, and you won't be entitled to a refund for any unused airtime. If you're porting a phone number to us from another company, we may not be able to provide some services, such as 911 location services, immediately.
II. CHARGES/PAYMENTS/DEFAULT a. Generally. You are responsible for paying all charges, including but not limited to: airtime, access, features, voice mail access, voice mail delivery, data usage, text messages, downloadable, alerts, roaming, long distance, directory and operator assistance charges, the price of Devices and accessories, charges for other goods and services and shipping/handling fees. You will be billed at domestic airtime or roaming rates for 800, 866, 877, 888, and other "toll free" calls. Applicable international wireless long distance charges, if applicable, will be charged for calls placed from your wireless phone. For all incoming Service, the length of the call will be measured during the time that you are connected to our system, which is approximately from the time you press "Send" or other key to answer a call until approximately the time you press "End" or other keys to terminate the call. For all outgoing Service, the length of the call will be measured from when you are released by the automated balance notification system until approximately the time you press "END" or other key to terminate the call. Airtime usage on each call is deducted in full minute increments, with partial minutes of use rounded up to the next full minute. For calls placed in the United States, you will not be charged for busy or unconnected calls if you press "End" or "No" within a reasonable time. Call waiting, 3-way calling, call forwarding, voicemail will incur applicable airtime or roaming and wireless long distance charges.
b. Account Balance. All charges incurred will be deducted automatically from your account. Any amounts loaded into your account are not transferable or refundable. You should take reasonable efforts to safeguard your Phone and replenishment airtime cards. No refunds or other compensations will be given for returned, expired, lost, damaged, or stolen cards. Airtime expiration varies by card denomination. If additional amounts are placed into your account before the current account balance expires, the existing balance will be carried over to the new expiration date. If new amounts are not added to your account prior to the expiration date any remaining amounts will be forfeited. If your account balance remains zero for 30 days you may lose your Number. In some instances you may be able to complete a call when the billing functionality is interrupted. When this occurs you will not receive correct balance information. All calls, however, will be deducted from your account and the balance updated when the billing functionality is operable. You are responsible for all data usage sent through our network and associated with the Device, regardless of whether the Device actually receives the information. In some cases our network will re-send certain packets to ensure complete delivery. In these cases you will be responsible for paying for the re-sent packets.
c. Use of Service/Rates. Your Service rates and other charges and conditions for each Number or Phone are described in the Rate Card or at our website at www.H2OWirelessService.com. You can place domestic and international calls from the U.S. to certain designated international locations. Weekday and night & weekend rates may vary. Night and weekend hours are 9:00 p.m. - 6:59 a.m. Monday - Friday, and all day Saturday and Sunday. Per-minute rates include roaming in all H2O Wireless network cities and domestic long distance charges. Off network roaming calls and direct dialed international calls will incur additional per minute charges on top of the standard airtime rates. For off-network roaming and direct dial international rates, please see store, contact service provider or visit www.H2OWirelessService.com for more details. All rate change notices will be provided either through dealer, rate card or www.LocusPlatinum.com. The prepaid per minute rates are based on the card value purchased. International rates vary and are subject to change. Call Customer Service (at the number listed on our website or in your replenishment card packaging) or visit www.LocusPlatinum.com for international rates and available countries. You cannot use the Service to place calls to 500, 700, 855, 900 or 976 numbers; or to place operator-assisted calls such as third-party-billed, and collect calls. Rates for calls to directory assistance are $1.25 per call plus airtime or roaming charges. You will be billed at domestic rates for 800, 888, 877, and 866 number calls. You are responsible for all taxes and surcharges associated with your use of the Service. Other than calls to 911, you can only make and receive calls when your account has a positive balance. Special dialing patterns may be required when making roaming calls. There may be surcharge for incoming calls made from pay phones. Prepaid wireless service is not available for purchase in all areas. Voicemail setup, deposits and retrievals are billed at a regular airtime rates and will deplete balance. If a caller reaches or leaves a message on your Voicemail, it will deplete your minutes even if your Voicemail box has not been activated. A Domestic text message will be charged at 10¢ to receive or send. International text messages will be charged at 20¢ to send and 10¢ to receive. Please note that a 2-way text capable phone is required to send and receive text messages. When using Call Waiting or Three-Way Calling, you will incur two simultaneous airtime charges and if you disconnect from a conference call while the other two parties remain connected, you will continue to incur airtime charges for all calls.
d. Default/Termination. If you breach any representation to us or fail to perform any of the promises you made in the Agreement, you will be in default and we may, without notice to you, suspend Service and/or terminate this Agreement, in addition to all other remedies available to us.
e. Account Information. Any person able to provide your Number and personal identification number is authorized by you to make changes to your account. You consent to disclosure of any information about you to any person as permitted by law if any Device programmed with your Number calls an emergency service number such as 911 or, if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay
f. CPNI Consent. Under federal law, you have a right, and we have a duty, to protect the confidentiality of information about the amount, type, and destination of your wireless service usage (CPNI). You consent to us sharing your CPNI with Locus Telecommunications, Inc., its affiliates and its contractors, to develop or bring to your attention any products and services. This consent survives the termination of your Service and is valid until you remove it. To remove this consent at any time, notify us in writing at Locus Telecommunications, Inc. Att: CPNI, P.O. Box 376 Fort Lee, NJ 07024, providing your name, home address, home telephone including area code, and personal identification number. Removing consent will not affect your current Service.
III. CHANGES TO THIS AGREEMENT We may amend the terms of this Agreement, including rate changes, upon advance notice to you either through dealer, replenishment package or www.H2OWirelessService.com.
IV. LIMITATIONS The parties intend that the limitations on liability, warranty and damage awards provided for in this Agreement will apply to the fullest extent allowed by law. Some jurisdictions do not allow the exclusion of certain warranties or the waiver, limitation or exclusion of liability for punitive, incidental or consequential damages, or for intentional or willful conduct in some circumstances. To the extent that any of these limitations are not permitted by applicable law, they will not apply to you.
a. Limitation of Liability. WE ARE NOT LIABLE FOR ACTS OR OMISSIONS OF ANOTHER SERVICE PROVIDER OR ANY THIRD PARTY PROVIDERS OF SERVICES RELATED TO USE OF THE DEVICE OR SERVICE, FOR INFORMATION PROVIDED THROUGH YOUR DEVICE, LACK OF PRIVACY OR SECURITY EXPERIENCED WHEN USING THE DEVICE, EQUIPMENT FAILURE OR MODIFICATION, OR OTHER CAUSES BEYOND OUR REASONABLE CONTROL, INCLUDING WITHOUT LIMITATION ANY REPRESENTATIONS THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM UNAUTHORIZED ACCESS (INCLUDING THIRD PARTY HACKERS OR DENIAL OF SERVICE ATTACKS). WE ARE NOT LIABLE FOR SERVICE OUTAGES NOR FOR SERVICE LIMITATIONS OR INTERRUPTIONS, AS DESCRIBED IN PARAGRAPH 1.C ABOVE. OUR LIABILITY AND THE LIABILITY OF ANY UNDERLYING CARRIER FOR ANY FAILURE OR MISTAKE SHALL IN NO EVENT EXCEED OUR SERVICE CHARGES DURING THE AFFECTED PERIOD. WE AND ANY UNDERLYING CARRIER ARE NOT LIABLE FOR ANY INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES SUCH AS LOST PROFITS. YOU AND WE BOTH WAIVE TO THE FULLEST EXTENT ALLOWED BY LAW, ANY CLAIMS TO RECOVER INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES. WE AND ANY UNDERLYING CARRIER ARE NOT LIABLE FOR (i) ECONOMIC LOSS OR INJURIES TO PERSONS OR PROPERTY ARISING FROM USE OF THE SERVICE, THE DEVICE OR ANY EQUIPMENT USED IN CONNECTION WITH THE DEVICE UNLESS CAUSED BY OUR SOLE AND GROSS NEGLIGENCE, OR (ii) THE INSTALLATION OR REPAIR OF THE DEVICE BY ANY PARTIES WHO ARE NOT OUR EMPLOYEES. THIS PARAGRAPH SHALL SURVIVE TERMINATION OF THIS AGREEMENT.
b. Indemnification. YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD US, OUR AFFILIATES AND AGENTS AND ANY OTHER SERVICE PROVIDER, HARMLESS FROM CLAIMS OR DAMAGES RELATING TO THIS AGREEMENT OR YOUR PROMISES OR STATEMENTS MADE IN IT AND USE OF THE DEVICE OR SERVICE UNLESS DUE TO OUR SOLE AND GROSS NEGLIGENCE. YOU ALSO AGREE TO PAY OUR REASONABLE ATTORNEYS' AND EXPERT WITNESS FEES AND COSTS INCURRED IN ENFORCING THIS AGREEMENT THROUGH APPEAL EXCEPT AS PROVIDED IN PARAGRAPH 5, BELOW. USE OF YOUR DEVICE WHILE OPERATING A MOTOR VEHICLE OR IN ANOTHER DISTRACTED OR NEGLIGENT MANNER MAY BE PROHIBITED OR RESTRICTED BY LAW IN SOME AREAS. IT IS YOUR RESPONSIBILITY TO CONFORM TO ALL SUCH LAWS OR REGULATIONS AND YOU SHALL INDEMNIFY US FROM CLAIMS ARISING FROM ANY SUCH UNLAWFUL OR NEGLIGENT USE. THIS PARAGRAPH SHALL SURVIVE TERMINATION OF THIS AGREEMENT. c. No Warranties. WE MAKE NO EXPRESS WARRANTY REGARDING THE SERVICE OR THE DEVICE OR ANY SERVICES PROVIDED BY ANY THIRD PARTIES, AND DISCLAIM ANY IMPLIED WARRANTY, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT AUTHORIZE ANYONE TO MAKE ANY WARRANTY ON OUR BEHALF AND YOU SHOULD NOT RELY ON ANY SUCH STATEMENT. WE ARE NOT THE MANUFACTURER OF THE DEVICE AND ANY STATEMENT REGARDING IT SHOULD NOT BE INTERPRETED AS A WARRANTY. THIS PARAGRAPH SHALL SURVIVE TERMINATION OF THIS AGREEMENT.
V. RESOLUTION OF DISPUTES PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS RIGHTS THAT YOU MAY OTHERWISE HAVE. IT PROVIDES FOR RESOLUTION OF MOST DISPUTES THROUGH ARBITRATION INSTEAD OF COURT TRIALS AND CLASS ACTIONS. ARBITRATION IS FINAL AND BINDING AND SUBJECT TO ONLY VERY LIMITED REVIEW BY A COURT. THIS ARBITRATION CLAUSE SHALL SURVIVE TERMINATION OF THIS AGREEMENT.
a. Binding Arbitration. This provision is intended to be interpreted broadly to encompass all disputes or claims arising out of our relationship. Any dispute or claim, including those against any of our subsidiary, parent or affiliate companies, arising out of or relating to this Agreement, our Privacy Policy or the Service or any equipment used in connection with the Service (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration except that (1) you may take claims to small claims court if they qualify for hearing by such a court, or (2) you or we may choose to pursue claims in court if the claims relate solely to the collection of any debts you owe to us.
b. Arbitration Procedures. You must first present any claim or dispute to us by contacting Customer Service to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute has not been resolved within 90 days. The arbitration of any dispute or claim shall be conducted in accordance with the American Arbitration Association ("AAA") under the Wireless Industry Arbitration Rules ("WIA Rules"), as modified by this Agreement. The WIA Rules and information about arbitration and fees are available upon request from the AAA online at www.adr.org. You and we agree that this Agreement evidences a transaction in interstate commerce and this arbitration provision will be interpreted and enforced in accordance with the Federal Arbitration Act and federal arbitration law. Unless you and we agree otherwise, any arbitration will take place in the county seat for the county in which your billing address is located. At either party's election, the arbitration shall be held telephonically. An arbitrator may award any relief or damages (including injunctive or declaratory relief) that a court could award, except an arbitrator may not award relief in excess of or contrary to what this Agreement provides and may not order relief on a consolidated, class wide or representative basis. In any arbitration applying the WIA Rules applicable to large/complex cases, the Arbitrators must also apply the Federal Rules of Evidence, and the losing party may have the award reviewed in accordance with the review procedures set forth in the WIA Rules. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration clause is determined by a court to be inapplicable or invalid, then the remainder shall still be given full force and effect.
c. Costs of Arbitration. For claims of less than $1,000, you will be obligated to pay $25 and we will pay all other administrative costs and fees. For claims over $1,000 but under $75,000, you will be obligated to pay your share of the arbitration fees, but no more than the equivalent court filing fee for a court action filed in the jurisdiction where your billing address is located. For arbitrations in excess of $75,000, all administrative fees and expenses of arbitration will be divided equally between you and us. In all arbitrations, each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration.
d. Waiver of Class Actions. By this Agreement, both you and we are waiving certain rights to litigate disputes in court. You and we both agree that any arbitration will be conducted on an individual basis and not on a consolidated, class wide or representative basis. If for any reason this arbitration clause is deemed inapplicable or invalid, or to the extent this arbitration clause allows for litigation of disputes in court, you and we both waive, to the fullest extent allowed by law, any right to pursue any claims on a class or consolidated basis or in a representative capacity.
e. Limitations Period. Any arbitration or legal action with respect to any and all claims or causes of action related to or arising out of this Agreement must be brought within two years after the cause of action arises, or within the applicable statutory period of time, whichever is shorter. This limitations period does not apply to any given cause of action when the statutory limitations period for that cause of action cannot be waived, restricted or otherwise limited by you.
VI. MISCELLANEOUS a. Privacy. We are not liable for any lack of privacy which may be experienced with regard to the Service. You authorize our monitoring and recording of calls to us concerning your account or the Service and consent to our use of automatic dialing equipment to contact you. We have the right to intercept and disclose any transmission over our facilities in order to protect our rights or property.
b. Assignment. We may assign all or part of this Agreement without such assignment being considered a change to the Agreement, and without notice to you. We are then released from all liability. You may not assign this Agreement without our prior written consent.
c. Notices. We may send you notices by mail or electronic means, in our sole discretion. Notices to you shall be effective 1) 3 days following the date deposited in the U.S. Mail or delivered to a nationally recognized courier or delivery service, postage prepaid and addressed to your address as kept in our files and/or 2) immediately upon our transmission using an electronic means such as e-mail or text messaging service. You are responsible for notifying us of any changes in your mailing or e-mail address. Written notice to us shall be effective when directed to our Customer Service Department (at the mailing address listed on our website) and received by us. Your notice must contain specific information adequate to identify you and your Service. Oral and electronic notices shall be deemed effective on the date reflected in our records.
d. Entire Agreement. These Terms and Conditions, together with the Sales Information, represent the entire agreement between you and us, which may only be amended as described in this Agreement. This Agreement supersedes any inconsistent or additional representations made to you by any of our representatives, agents or dealers. If any part of this Agreement is found invalid, the balance of the Agreement remains enforceable. If, at any time, we do not enforce any right or remedy available under this Agreement, that failure is not a waiver of our right to enforce the right or remedy at a later time. Copied, microfiched, scanned or other duplicate or electronic images of this Agreement are admissible for all purposes.
e. Governing Laws. This Agreement is subject to applicable federal laws, federal or state tariffs, if any, and the laws of the state associated with the Number. Where our Service terms and conditions are regulated by a state agency or the FCC, the regulations are available for your inspection; if there is any inconsistency between this Agreement and those regulations, this Agreement shall be deemed amended as necessary to conform to such regulations.
f. Capacity. You represent that you are legally competent to enter into this Agreement, and that you are not aware of any disability that would prevent you from entering into this Agreement.
g. You shall acquire no proprietary interest in the Number assigned by H2O Wireless for its use, except for any rights federal law grants.
h. The supplier of Services to H2O Wireless shall have no liability whatsoever for the losses, claims or damages for any cause whatsoever, including but not limited to any failure or disruption of Services provided hereunder, regardless of the form of action, whether in contract or in tort or otherwise, You shall not be deemed a third-party beneficiary of any contract between H2O Wireless and the underlying carrier.

The system will start a brief tutorial session on how to set up your voicemail box. You will be prompted for the temporary passcode. This passcode is your wireless phone number (area code + number). Once the permanent passcode is established and you set the greeting type, your voicemail box is ready. Now, you can retrieve message from your wireless phone or dialing your wireless phone number from a landline phone.

If you placed an order for a Starter kit that does not need to be shipped, like H2O Wireless/Locus Platinum CDMA starter KIT, then the phone activation instructions will be e-mailed to you not later than the next business day.
If for any reason we can't fulfill your order by the next business day due to technical issues or because the requested phone number is being out of stock, we will contact you by phone or e-mail. We will cancel the order and issue a full refund at your request if we can't fulfill your activation request timely.
For the first time customers who purchase Mobile recharge cards, it might take anywhere from few minutes to 48 hours to receive the order, as our credit card fraud protection policy requires order verification. We will call you back to verify the order as soon as it is possible. Resolving problems
If your handset is newly activated, ensure that enough time has been allowed for the system to activate the phone. Check to see that the airtime minutes were loaded on the handset. If the problem persists, dial SEND END CLEAR from your handset (this is a FREE call) or contact Customer Care from any phone at 1-800-643-4926. Please have your mobile number and IMEI ready.
Your 4-digit PIN will be the last 4 digits of your Activation Card PIN. You will need to use this PIN to access or to add airtime to your account. If you do not know your PIN or if you would like to change your PIN, call 1-800-819-7696.

H2O Broadband is no-contract, prepaid wireless data service that connects you to high-speed internet on a mobile broadband-capable USB device through our Nationwide largest GSM wireless network. H2O Broadband works on desktops, tablets, netbooks, and laptops.
With mobile broadband, you can access internet anytime and anywhere only in the U.S. and Puerto Rico whereas WiFi requires you to purchase internet access or provide user log-in. H2O Broadband uses 3G services, average download speeds up to 7.2 Mbps and upload speeds up to 5.76 Mbps.

Using H2O Broadband USB Device
- Remove the H2O Broadband Data simcard from the package and insert it in the H2O Broadband USB device.
- Locate a USB port on your computer and connect the H2O Broadband USB device into the port.
*Remember-Some computers need to be restarted in order for the SIM Card to be recognized.
H2O data card comes inactive. To activate the service, please log on to H2OBroadband.com/activate and follow the directions or call 1-800-550-6403 and follow the prompts. Please have the 10-digit number found on the back of the H2O Broadband Data SIM card and 12-digit PIN number found on the H2O Broadband Data Card.
Once you've plugged the device into your computer, install the Sierra Wireless AirCard software automatically. This is a seamless, no CD installation experience, so setup is quick and easy for both MAC and Windows users.
